Terms of Service

These Terms of Service ("Terms") govern your use of the OMPT Trainer website (ompt-learning.com) and the associated trainer application (app.ompt-learning.com), together the "Service". The Service is operated by Innovations-UX ("we", "us", "our"). By creating an account, buying a pass, or otherwise using the Service, you agree to these Terms.
1. What the Service is — and is not
OMPT Trainer is an independent preparation tool. It is not the official OMPT exam and is not affiliated with, endorsed by, or connected to the providers of the official OMPT test (booked and sat at omptest.org) or with any university. Using our Service does not register you for, guarantee, or in any way affect the result of any official examination. Pass marks, fees, attempt limits and exam content are set by third parties and may change at any time; always verify requirements with your university and the official exam provider.
2. Accounts
You need a free account to use most of the Service. You are responsible for keeping your sign-in details and email inbox secure and for all activity under your account. You must provide an accurate email address and be old enough to enter into a contract in your country of residence. We may suspend or close accounts that breach these Terms.
3. Premium passes — one-off, no subscription
- Premium is sold as a one-off payment ("pass"). There is no subscription, no recurring billing, and nothing to cancel — a pass simply unlocks Premium features for a fixed period and then ends.
- The 1-month pass grants 30 days of Premium access; the 3-month pass grants 90 days. The access period starts when the payment is confirmed.
- Prices are shown in euros (EUR) and include any applicable taxes. Payments are processed securely by our payment provider; we do not store your card details.
- When a pass expires, Premium features lock again. Your free account, your practice progress and your data remain available unless you ask us to delete them.

4. Acceptable use
You agree to use the Service for your own personal exam preparation only. You must not:
- copy, scrape, resell, redistribute, or publish our questions, courses, solutions or other content;
- share your account, pass, or access with others;
- attempt to bypass payment, access controls, or usage limits;
- probe, attack, overload, or disrupt the Service or its infrastructure, or use automated tools to extract content;
- misuse the AI tutor or any feature to generate unlawful, harmful, or abusive content;
- use the Service in any way that is unlawful or infringes the rights of others.
5. Intellectual property
All content provided through the Service — including questions, explanations, courses, study plans, software, and branding — is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable, non-exclusive licence to access and use the content for your own preparation while your account or pass is valid. No other rights are granted.
6. Availability and changes
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may add, change, or remove features, and we may update content for accuracy. We may revise these Terms; the current version is always posted on this page with its date, and material changes will take effect when posted.
7. Disclaimer and limitation of liability
The Service is provided on an "as is" and "as available" basis. We do not warrant that practising with the Service will result in a pass, a particular score, or any specific outcome on the official OMPT or any other examination. To the fullest extent permitted by law, we exclude implied warranties and we are not liable for indirect, incidental, or consequential losses, or for exam results, missed exam dates, or decisions you take based on the Service. Nothing in these Terms limits liability that cannot be limited under applicable law (including liability for death or personal injury caused by negligence, fraud, or your mandatory consumer rights). Where our liability cannot be wholly excluded, it is limited to the amount you paid us for the pass in question.
8. Governing law and disputes
These Terms are governed by French law, without prejudice to the mandatory consumer-protection rules of the European Union and of your country of residence. Disputes fall under the jurisdiction of the competent French courts, again without prejudice to any mandatory protections available to you as a consumer. EU consumers may also use the European Commission's Online Dispute Resolution platform.
